Cerebral Palsy
CP is not a disease or an illness. It is a physical impairment brought about
by injury to specific areas of the brain.
There are 3 main types of CP, spastic, athetoid and ataxic.
Sadly there is no cure for the condition once it has been diagnosed. A
diagnosis can take up to 18 months and more. It has been suggested that the
right care and treatment provided early can have very positive benefits for
the individual with CP in the future.
A number of reasons which could account for CP occurring but under the
sphere of medical claims they mostly relate to complications arising at
birth and a lack of oxygen being supplied to the brain.
CP is the most common category of injury claim brought against healthcare
providers. In 1999-2000 around 80% of all outstanding claims against the NHS
were in respect of CP and Brain Injury claims.
According to published research, it is considered that 1 in 10 cases of CP
occur as a result of birth complications.
If you are the parent of a child with suspected CP arising out of birth
complications then you may have many worries and maybe aren’t too sure where
to turn.
The owners of The Medical Accident Group care passionately about the
sanctity of life and know just how precious your baby is to you. That’s why
we work to try and understand your immediate concerns and ask our lawyers to
work with you and help deal with each issue.
Your thoughts may turn on what the future holds for your baby. The beauty
about life is that we’re all different and so it is with CP. How each person
is affected by CP is as unique as they are. The effects of CP on your baby
can range from the barely noticeable to issues that require a higher degree
of care.
You are not alone in this and there are organisations and support groups
that you should get in touch with. SCOPE offers a fantastic resource for
people with CP and their families. We have attached their web link at the
bottom of this page.
Your child may need a lot of support and care in the formative years and
beyond. Looking that far ahead can be a daunting prospect but our lawyers
work with healthcare specialists and financial experts who can put together
a claim for disability management aids and ensure you get a settlement that
looks after your child for the rest of their life.
In fact the National Audit Office reported that in 2000 the average
settlement for CP cases was £1.03 million. That figure is likely to have
risen now and some of our lawyers have settled CP cases for as much as £4
million.
Bringing a claim is a big responsibility and as parents you will want to do
the very best you can for your baby. Whatever you do, don’t go to the
nearest solicitor. Read on and see why contacting us can make all the
difference to your child and you.
The lawyers working with The Medical Accident Group have been able to bring
many successful claims, where it was originally thought by other lawyers
that there was no claim to bring. This highlights just how vital it is to
place your claim with the right lawyers.
Under current laws, an adult has 3 years in which to bring a claim for
compensation once they are aware that they have suffered as a result of a
medical accident.
This is no the case for children as they have 3 years from reaching the age
of 18yrs.
